Obligations of Touch Residential Pty Ltd

Touch Residential Pty Ltd is bound by and committed to the limitations of the Privacy Act (1988) and the Australian Privacy Principles (2014). We place in the highest regard the trust that our clients have in us to protect their personal information.

Collection of data

We will only obtain necessary data and personal information from our clients in order for us to effectively and efficiently perform the service that we have been engaged to do. Our real estate service will always be executed as per the parameters in the Property Occupations Act legislation.

Data will be requested in the following situations from our sales department/volunteered by the client:

  • At the time of enquiry
  • At the time of entering a property viewing / open house
  • At the time of offer submission
  • At the time of contract negotiation

Data will be requested in the following situations from our property management department/volunteered by the client:

  • At the time of enquiry
  • At the time of entering a property viewing / open house
  • At the time of application including when reference checking
  • At the time of lease preparation and other associated documentation
  • At the time of honouring the requirements of a maintenance request
  • At the time of periodic tenancy updates i.e. routine inspections/lease renewals
  • At the time of notification to vacate and the vacate process to follow

We may need to seek additional information from the following sources:

  • Prior agents
  • Personal references
  • Employers
  • Relevant tenancy or property databases

Use of data

The purpose for collecting and retaining personal client information is solely to offer a complete service in accordance with our service offering that has been acknowledged by the client and to comply with all relevant legislation and legally binding documents such as Form 6 Appointments for sales or letting, sales contracts and lease agreements.

Information disclosure

Touch Residential Pty Ltd will disclose your personal information to other entities in the following instances:

  • When submitting rental applications to landlords
  • If requested to prove our legal compliance
  • If requested by our auditors
  • If requested to fulfil requirements of tribunal hearings
  • If fraud or criminal activity is identified/suspected

We will not disclose information held outside of the above circumstances without your approval.

Should you request access to the personal information we hold and your request is denied, we will provide you with the reason.

Enquiries and forms on this website

When you submit an enquiry, appraisal request or offer through this website, we collect the details you enter, such as your name, contact details, the relevant property address and your message. We use them to respond to you and to provide the service you have asked about, and they are recorded in our customer management system. A copy of each enquiry is also emailed to our team through a transactional email provider (Resend, with servers in the United States) so we can respond quickly. Our forms are protected by Cloudflare Turnstile, a bot-detection service that processes technical information about your browser and connection to tell people apart from automated traffic. Cloudflare describes its handling of that information in its privacy policy.

Maintenance requests

Maintenance requests are handled by Tapi, a third-party maintenance-management service. The request form on our maintenance page is provided by Tapi and displayed within our website, and the details you enter there, including your name, contact details, the property address, your description of the problem and any photographs you attach, are collected by Tapi rather than by this website. Tapi uses them to triage the request and to pass it to us and, where relevant, to the tradesperson attending. Tapi is a New Zealand company, and its privacy policy states that the information it holds may be stored or processed in New Zealand, Australia, the United States, France or other countries where it operates. Tapi handles that information under its own privacy policy. If you would rather not use the form, you can call or email us instead, and the details on our maintenance page tell you how.

Property, rental and suburb reports

The free property, rental and suburb reports on this website are generated by Cotality (RP Data Pty Ltd trading as Cotality, formerly CoreLogic), a third-party property data provider. When you search an address and enter your details to receive a report, those details, including your name, contact details and the property you searched, are collected by Cotality to generate and email your report, and are shared with our team so we can follow up on your enquiry.

The report tool also collects information about how it is used, including through cookies and similar identifiers set in your browser, and this collection is active by default on the report pages. Cotality handles the information it collects under its own privacy policy.

Cookies and website analytics

Our own website measurement is anonymous. We record events such as which report pages are viewed, whether the report tool loaded and when a form is submitted, and these events contain no names, contact details or identifiers that follow you between visits.

We also use Google Analytics 4, a service provided by Google, to understand how the website is used, for example which pages are visited and how visitors reach them. Google Analytics sets first-party cookies in your browser (named _ga and _ga_ followed by an identifier) to distinguish your browser across visits and sessions, and the same measurements we record ourselves are shared with it. Google processes technical information such as your IP address to derive an approximate location and, in Google Analytics 4, does not log or store it. Google handles this information under its own privacy policy. You can stop Google Analytics from collecting information about your visits by installing the Google Analytics opt-out browser add-on.

We do not set advertising cookies, use remarketing or run third-party ad trackers. The Cotality report tool sets its own cookies and identifiers as described above, and our hosting provider processes technical information such as IP addresses in server logs to deliver and secure the site.

Your personal information can only be accessed by Touch Residential Pty Ltd staff and those you authorise. Your personal information can only be altered or removed by authorised means.

Touch Residential Pty Ltd may change or make updates to its Privacy Policy periodically. The most updated version will be displayed on our website at all times for your reference.

Touch Residential Pty Ltd has no ability to control the privacy policy built by third party companies that our webpage may provide links to. It is recommended to users to review individual policies if they choose to leave our web domain.

If you have a complaint about how we have handled your personal information, please contact us first. We will acknowledge your complaint, investigate it, and respond to you within a reasonable time.
